GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale govern the purchase of products and services offered on the website www.dream-shop.it (hereinafter, the "Site") by users qualifying as consumers under Legislative Decree 206/2005 ("Consumer Code"), as well as professionals or businesses (buyers with VAT number), as well as sales made in dropshipping, B2B, and wholesale.

The Site is managed by Omega Srl, with registered office at Corso Venezia 19/A, 10147 Turin (TO), VAT number 11676860015, contact email: info@dream-shop.it (hereinafter, also the "Seller").

1. Subject

These conditions govern the distance selling of goods through the Site. Each order implies full acceptance of these conditions. The applicable conditions are those published on the Site at the time of the order. Any changes will take effect only for orders placed after publication.

2. Service Recipients

The Site allows purchases for:

  • Consumers (natural persons of legal age acting for purposes unrelated to their professional activity);
  • Businesses, professionals, resellers with VAT number;
  • Dropshipping customers

For non-consumer customers:

  • The right of withdrawal does not apply;
  • The legal warranty of the Consumer Code does not apply;
  • Disputes will be submitted to the exclusive jurisdiction of Turin;
  • The contract is governed by Italian law, excluding the Vienna Convention;
  • Mandatory protections for consumers do not apply.

3. Product Information

Products are described as accurately as possible. Images are for illustrative purposes. Minimal variations do not constitute non-fulfillment. Prices include VAT, unless otherwise stated, and are subject to change without notice.

The online catalog is updated in real time. However, product availability may vary. In case of unavailability after the order, the user will be promptly informed and can choose whether to wait, replace the product, or obtain a refund.

Products may be subject to special offers, discounts, or temporary promotions that may involve additional conditions, specified in each promotional campaign.

4. Purchase Methods

The user selects the products, adds them to the cart, and follows the checkout procedure. The order constitutes a binding contractual proposal. The contract is finalized with the sending of the order confirmation via email. Phone orders and those taken on WhatsApp can be manually entered in the back office and have the same validity as those submitted on the site. The Seller reserves the right to refuse incomplete, untruthful, or non-compliant orders.

The buyer, before submitting the order, is required to verify the accuracy of the entered data. Any errors can only be corrected before the order confirmation.

5. Prices and payments

Prices are expressed in Euros, VAT included. Shipping costs are indicated at checkout. Accepted payment methods:

  • Credit/debit card
  • PayPal
  • Bank transfer
  • Cash on delivery
  • Postepay top-up
  • Satispay
  • Klarna

Payment data is never stored by the Seller. The crediting of the payment is a condition for shipping.

5.1 Cash on delivery order payment

5.1 For deliveries with cash on delivery payment, an additional cost of €10 is required. Please note that failure to collect a package with cash on delivery will incur costs that are the responsibility of the customer who did not collect the ordered goods.

5.1.2 In the event that the customer does not collect the goods purchased on cash on delivery, they will be charged for shipping, storage, and return shipping to the Dream Shop headquarters amounting to €35 or more in the case of bulky packages or multiple shipments, in addition to the handling fees of the debt collection agency (only in case of non-payment of fees after a reminder from Dream Shop). We remind you that at the time of purchase, the customer enters into a sales contract with Dream Shop, which must be respected by both parties. In case of refusal of the ordered goods and failure to settle the fees, we will activate the debt collection agency, which will proceed legally to collect the amount due. This amount may be deducted from any deposit paid by the customer. In case of non-payment of fees, we will proceed with forced recovery of the amounts with additional costs and report to the authorities for the crime of fraudulent insolvency (Art. 641 of the Penal Code) punishable by 2 years of imprisonment and a €516 fine. 

5.2 Complete cash on delivery regulations

  1. Once the order is confirmed, an additional message will be sent via WhatsApp, SMS, or email; once confirmed, it will no longer be possible to cancel it.
  2. Once the order is shipped, it can only be canceled by paying the shipping and non-delivery fees (outbound, storage, and return) amounting to €35 or more.
  3. By choosing cash on delivery, the buyer commits to collecting and paying for the goods: the package cannot be refused for any reason.
  4. The buyer is required to provide a correct and monitored address for delivery.
  5. It is necessary to indicate the correct name on the doorbell or communicate it in advance.
  6. In case of problems with the doorbell, the buyer must inform Dream Shop.
  7. The courier is not required to call before delivery.
  8. Specific delivery times cannot be chosen.
  9. The courier makes two delivery attempts. After the second failed delivery, the package will be held, and the customer must collect it within 10 days.
  10. The movements of the courier are tracked with GPS.
  11. Courier delays do not justify refusal of the package.
  12. Failure to deliver due to refusal, incorrect address, or unavailability incurs a minimum charge of €35.
  13. In case of non-payment, legal action will be taken for fraudulent insolvency.
  14. By confirming the order, the customer declares acceptance of these conditions.
  15. Even in case of delay in delivery beyond 30 days, the order must still be collected, it cannot be canceled, under penalty of a fee. 

6. Shipping and delivery

Shipping is entrusted to an express courier. Average times NOT guaranteed: 2-4 weeks. The risk passes to the buyer upon delivery to the carrier. The Seller is not responsible for delays attributable to the courier. In case of delay in delivery beyond 30 days, the order remains valid and must be collected. Deliveries may be delayed during holiday periods and for reasons not attributable to us. 

In case of dropshipping, shipping may occur directly from third-party suppliers. The Seller is not responsible for logistical errors, delays, hidden defects, or damages caused by third parties.

Shipping costs vary based on weight, destination, and selected method, and will be clearly indicated before order confirmation.

7. Right of withdrawal (for consumers only)

The consumer may withdraw within 14 days from delivery. The communication must be sent to info@dream-shop.it. The product must be returned intact and in its original packaging. Return shipping costs are the responsibility of the customer.

The following are excluded from the right of withdrawal:

  • Items made by hand and/or customized/vintage such as Levis, Converse, and tailored suits (Art. 50, Consumer Code).
  • For hygiene reasons, exchanges and returns are not accepted on underwear, shoes, masks, and swimsuits.
  • Items in size XXL, XXXL, XXXXL, 48, 50, 52, etc. cannot be replaced as they are made to order and tailored to the customer. Please check the measurements carefully before purchasing and/or ensure through customer service WhatsApp +39 3533744357 that the size is suitable for your body type.
  • Items costing less than €50 (Article 47, paragraph 2, Consumer Code).
  • Real fur items (fox, raccoon, etc.) as they are made to measure and at the explicit request of the final customer.
  • Household items such as linens, rugs, curtains, etc.
  • Items requested by the customer not present in the catalog and/or on our website

    The refund will be made using the same payment method used by the customer, unless otherwise agreed.

8. Legal warranty (only for consumers)

Duration: 2 years from delivery. Defects must be reported within 2 months of discovery, with photographic documentation. The consumer is entitled to:

  • Free repair or replacement;
  • Partial or total refund, if the previous options are not feasible.
  • Damages resulting from are excluded:
  • Misuse;
  • Tampering;
  • Normal wear and tear.

9. Liability

The Seller is not responsible for:

  • Indirect or consequential damages;
  • Loss of data or failure to use;
  • Delays or failures due to force majeure or third parties (including dropshipping suppliers).

Maximum liability limited to the value of the order.

10. User obligations

The user agrees to:

  • Provide correct and updated data;
  • Do not share access credentials with third parties;
  • Do not engage in illegal or fraudulent activities on the Site.
  • The Seller reserves the right to block users in case of violations.

11. Intellectual property

All content on the Site (images, texts, trademarks) is protected by copyright. Reproduction, even partial, is prohibited without written authorization.

12. Processing of personal data

The processing is carried out in accordance with the EU Regulation 2016/679 (GDPR). The user accepts, with the order, also the Privacy Policy and the Cookie Policy.

13. Applicable law and competent court

For consumers: court of residence or domicile. For professionals and VAT: exclusive court of Turin.

14. Order and document archiving

Orders are archived for at least 26 months. The user can request a copy by writing to info@dream-shop.it.
